KARACHI, Oct 29: Additional district and sessions judge, East, Kauser Sultana, sentenced a man to suffer seven-year term for critically injuring a man on a domestic issue.

The judge also imposed a fine of Rs100,000 on Tahir Mahmood or he would have to undergo an additional one-year term in lieu of payment.

The Model Colony police had registered the case against him on May 21, 1998 on the complaint of his brother’s wife, Kauser. The accused stabbed his sister-in-law’s brother, Shakir Salim over a family conflict.

BAIL REJECTED: Additional district and sessions judge, South, Nuzhat Ara Alvi, rejected the bail application of an accused in a double-murder case.

Accused Abdullah was booked along with five others in the murder case of a transporter and his young son by the Kalakot police on the complaint of the victim’s brother.

The judge also issued a contempt of court notice against the superintendent of the Central Prison, for not producing the accused in the court. The court had on an earlier hearing fixed October 29 for the indictment of the accused.

Complainant Aurangzeb Khan Niazi reported to the police that accused Abdullah, his three sons, Ahmed Khan, Saifullah and Alam Khan, and Hakim Khan and Dilbar opened fire on the car (AEV-366) of his brother Bahadur Khan Niazi, who was going to court along with his son Habibullah Khan Niazi, and a private security guard, Asal Khan. Bahadur Khan and his son were killed instantly and their gunman was injured in the attack.

The attackers fired 44 bullets in all on the car and Bahadur received 11 of them. His son received four bullets.

Shahadat Awan, counsel for the complainant, opposed the bail application and submitted that the ocular evidence was duly corroborated by medical evidence.

He said the injured was an eye-witness to the incident and the accused were also seen by him. Moreover, the accused had enmity with the victims’ party and four criminal cases were already pending against them.

The judge fixed November 8 for the indictment of the accused.

MURDER CASE: District and sessions judge, South, Agha Rafique Ahmed Khan, adjourned the hearing of a murder case against a worker of the Pakistan Peoples Party and a woman.

Khalid Ali Shahansha and Sana Alamgir were booked in the murder case of Karim Khan alias KK on the complaint of the deceased’s son on April 4, 2003. Shahandsha obtained a pre-arrest bail, while Sana was in custody.

According to complainant Azim Khan, a day before the incident his father had told him that Khalid Shahansha had given him life threats.

According to the prosecution, the police received the information of the incident at flat No. C-25, Paradise Palace Apartments, Sarwar Shaheed Road. They found the body and the licensed pistol of the victim. The police also arrested a woman, Sana, from the flat. The woman disclosed that she had killed Karim Khan due to his atrocities.

During the course of the investigation, the complainant produced two eyewitness, Ishtiaq Ahmed and Ashfaq Ahmed, who stated that Khalid Ali and his associates had killed Karim Khan. According to the complainant, Ishtiaq was his father’s driver and Ashfaq was the chowkidar of the Paradise Palace Apartment.

However, later the police found that Ishtiaq was never seen with the deceased and Ashfaq was not the chowkidar.

According to the interim charge-sheet, Sana told the police that she had become unconscious as she heard the shot. However, her statement was later found to be false as during the relevant time she had been talking to her brother through her mobile phone.

The prosecution informed the court that two prosecution witnesses were present in the court for recording their statements.

However, Umer Farooq appeared on behalf of accused Sana and sought a long adjournment. The judge granted his application and fixed the case for December 5. The defence counsel also moved bail application for his client and the judge issued notice to the prosecution for November 1.

SENT TO JAIL: The additional district and sessions judge, West, Muhammad Sagheer Rana, sent two accused, absconding in a murder case, to jail.

Babar and Imran, who were booked for murdering Naeem Ahmed in Saeedabad in 2001, surrendered before the court.
