HYDERABAD, Sept 20: The Sindh High Court, Hyderabad circuit bench, on Friday directed the district police officer, operations, Dadu, to direct his subordinate staff to provide all relevant as well as necessary documents in police files to enable the state counsel to conduct prosecution in a fair manner.

The DPO, Dadu, also undertook in writing to issue directives to his subordinate staff and to take severe disciplinary action against the delinquent officials in case of any illegality.

The DPO had attended the court in response to a court order passed on Wednesday in connection with a bail application.

In response to a court query, the DPO said that there was no practice to place on police file the copy of entry made in the police station diary through the police file handed over to the state counsel.

Justice Azizullah M. Memon observed that such a statement on the face of it gave the impression that the police officers were not aware of the legal position that all necessary as well as relevant documents were to be placed in police files handed over to the state counsel to enable him not only to conduct prosecution of the case on behalf of the state but also give fair opinion regarding genuineness or otherwise of allegations made against the accused.

The matter pertained to accused Mairaj and Ali who had sought bail in a murder case through Advocate Khadim Hussain Shaikh. They were charge-sheeted after one Haji Roshan was gunned down within the jurisdiction of the Dadu police station and the case was lodged after a delay of five days.

The applicants’ counsel said that the body of the dead man was brought to the police station from where it was sent for postmortem but no entry was made in the police station and the incident was not witnessed by anyone.

He said that names of his clients appeared in the supplementary statements by the complainant of the case, Haji Toorh Jamali.

The court granted bail to the accused in a sum of Rs100,000 each.
