SC urged to review July 31 judgment

QUETTA: Senior lawyer Kamran Murtaza has filed a petition requesting the Supreme Court to review its July 31 verdict, which affected all judges of the Balochistan High Court.

The petition, filed in the Quetta Registry of the apex court, contends that affected judges were condemned without having been heard, rendering the judgment void and of no legal effect. 

The petitioner requested the court to allow parliament to address the matter. 

According to the petition, the judgement was passed when the affected judges were not ‘arrayed as respondents before the honourable court’.

‘Threats of being charged with misconduct before the Supreme Judicial Council for taking oath on Nov 3, 2007, forced all judges of Balochistan High Court to resign or retire and their this step was not voluntary.’

The petitioner said that the non-functioning of the high court was ‘not in the interest of the litigating public’.
