ISLAMABAD, Oct 3: Former chairman of Capital Development Authority (CDA) Farkhand Iqbal on Wednesday challenged the appointment of his successor, Syed Tahir Shahbaz.

On Tuesday Farkhand Iqbal filed against the appointment of Javed Iqbal Awan as chairman CDA but after the federal government issued another notification for the said appointment of Mr Shahbaz as CDA chairman, he withdrew his petition in the court of Justice Muhammad Anwar Khan Kasi. .

After the above mentioned change, former CDA chairman withdrew his petition from the court of Justice Muhammad Anwar Khan Kasi of the IHC and filed afresh.

Citing secretary establishment division and secretary cabinet division alongside his successor Tahir Shahbaz as respondents, the petitioner alleged that the appointment of new CDA boss replacing him was made in haste and it was illegal, unlawful and based on political consideration.

The petitioner contended that he was appointed for a term of five years and could be removed after expiry of the said term or under the prescribed procedure given in the CDA ordinance of 1960.

The petitioner adopted before the court that during his seven months at CDA, he initiated work on mega projects like extension of 7th Avenue, transport system of international standard, uninterrupted water supply to the residents and also resolved loadshedding issue in the city.Petitioner said that if the prime minister or his secretariat wanted any improvement in development projects, the same could be implemented in accordance with the provisions of CDA ordinance of 1960.

Conceding to political interference into the affairs of CDA, the petitioner said the prime minister constituted a task force for the political interference into the affairs of the authority but IHC Justice Shaukat Aziz Siddiqui suspended the order of the task force.

The petitioner alleged that due to his obedience to court orders, while trying to run CDA affairs without external interference ended up annoying some politicians whose interests were jeopardised and they ultimately managed his removal from his present post.

The petitioner has prayed to the court to set aside the notification of the appointment of Mr Shahbaz and restore him to his position.
