MULTAN: A complainant in a fraud case is reluctant to appear in Gujranwala district and sessions court, allegedly because he was receiving life threats from the accused persons, who include two police officers and a lower court judge.

Muhammad Ismail, a resident of Mauza Jungle Kalaranwala, Multan, alleged that 20 people, including an additional and sessions judge, a CIA DSP and an SHO deprived him and his brother of Rs35.5 million fraudulently.

Ismail claims he had dispatched complaints to various authorities, including the Supreme Judicial Council, Supreme Court chief justice, president of Pakistan, prime minister, chief minister, Lahore High Court chief justice against the ‘influential’ accused persons.

In his complaint, he stated that a gang of five people, including a woman, deceitfully lured his brother Muhammad Khalil into making an ‘investment’ in a machine which the fraudsters claimed would be used to make ‘currency’.

He said his brother, blinded by greed, got lured, collected Rs35.3 million by selling the family’s agriculture land and equipment, besides gold ornaments and handed over the amount to the fraudsters.

He said when after sometime his brother realised that he was tricked, he demanded his money back but the gang flatly refused to pay back the sum.

He said Khalil lodged an FIR (No 45/13) under section 406/420 with Daulat Gate police on Feb 21, 2013, against the accused, three of whom were later arrested by the police. The remaining accused persons were granted bail by the court of additional district and sessions judge.

He said during the investigation it was revealed that the accused got prepared a bogus pro-note of Rs1 million on Jan 8, 2013 and an Rs1.5 million affidavit on Jan 21, 2013 on behalf of his brother and in favour of one of the accomplices.

They also filed a law suit against the complainant and his brother.

He said his brother lodged a complaint with city police officer against the accused for preparing fake documents.

Meanwhile, he said, three other people contacted his brother and assured him that they could manage recovery of the amount with the help of a lower court judge against 33 per cent ‘commission’ of the total sum.

He said these three people arranged their meeting with the judge at his residence in Gujaranwala who called a CIA DSP and an SHO there.

Ismail alleged that the police officers and the judge got prepared a fake robbery complaint against the accused. The DSP and the SHO assured the judge they would recover the money after arresting the accused within couple of days.

He said the CIA police arrested two of the accused and the DSP and SHO arranged his meeting with him in a private lockup. The accused confessed their crime and assured they would return the money within two days.

He said after two days the accused handed over Rs2.4 million and a car to the DSP and the SHO. However, the both officials refused to return the amount to the complainant asking him to wait till the recovery of the whole sum and deduction of the commission.

He was told that the amount and the car would remain with the judge until complete recovery.

Ismail said he was asked to sign a statement saying he had received the money and car from the accused. His brother was also told to withdraw the case against the accused. As the brothers did what they were told to do, the police officials refused to return the money and started threatening them.

He said the judge and the police officers threatened to involve him in fake cases and even killing him in a staged encounter if he ever visited Gujaranwala again.

He claimed to have phone recordings of his conversations with the accused about the matter.

Ismail told this correspondent that in response to a complaint he had filed against the accused judge, he received a notice from Gujranwala D&SJ for appearance in his court on Dec 3, but he could not appear as he was receiving threats from the accused.

He said that he had filed an application seeking shifting of the case to some other court.

He said another notice sought his appearance before the D&SJ on Monday (today).

“How could I appear in a court in Gujaranwala when I am getting serious life threats,” he said.
