KARACHI, March 8: A sessions court on Thursday dismissed the bail application of a suspected midwife in the five foetuses case.

Nuzhat Aslam was arrested on Feb 23 at her 'clinic' in Chakra Goth in connection with the case of the five foetuses found in a garbage dump in a Manzoor Colony area on Feb 14.

The suspect, who is currently in jail custody, through her counsel moved a bail application in the court.

After hearing arguments from counsel for the defence and the public prosecutor, the additional district and sessions judge (south), Abdul Razzaq, dismissed the plea.

A case (FIR No 25/12) was registered under Sections 329 (concealment of birth by secret disposal of dead body), 338-B (isqat-i-janin or cause a pregnant woman to miscarry), 201 (causing disappearance of evidence of offence or giving false information to screen offence) and 34 (common intention) of the Pakistan Penal Code at the Mehmoodabad police station.

Show-cause notice to SHO

A judicial magistrate on Thursday issued a show-cause notice to the SHO of the Jackson police station for not complying with a court order regarding the arrest of three senior officials of the Federal Board of Revenue in a fraud case.

Senior investigation officer Saeed Iqbal, intelligence officer Jawad Sultan and senior officer Hafiz Mohammad Anis have been charged with forging reports and misleading investigations into the Afghan transit trade scandal.

The court issued a similar notice on previous hearing for his failure to arrest the suspects, but the SHO failed to submit a reply.

The magistrate, Afzal Roshan, issued another show-cause notice to the SHO for March 16 and ruled that the legal action would be taken against him if he again failed to submit a reply and comply with the court order.

A case (FIR No.605/11) was registered against the officials on the complaint of a deputy collector of the customs department at the Jackson police station.

Officials' explanation sought

An anti-terrorism court on Thursday sought explanation from the Sindh home secretary and the additional inspector-general (legal-II) about their failure to produce in court two undertrial prisoners in a case pertaining to the kidnapping of a Frontier Constabulary (FC) official and others for ransom.

Abdul Aziz Khan, Akhtar and Wali Mohammad alias Waloo were booked for abducting FC official Lieutenant-Colonel Anisur Rehman and his two friends in May 2010 within the remit of the Gadap police station and demanding a ransom for their release.

After the issuance of the order for their production, the jail authorities had informed the court that Aziz and Akhtar had been kept in a Gadani prison in connection with some other cases. Over the next couple of months, the court had written two letters to the home and police departments asking them to produce of the UTPs in court. On Thursday, ATC-III Judge Ghulam Mustafa Memon observed that no effort whatsoever seemed to have been made by the authorities for their production in court.

This attitude of the departments concerned had been responsible for the delay in the disposal of the case, pending since 2010, he further observed.

The judge directed the home secretary and the AIG (legal-II) to submit an explanation ensure production of the UTPs in court on March 20.

According to the prosecution, the Anti-Violent Crimes Cell (AVCC) and the Citizens-Police Liaison Cell (CPLC) jointly raided a farmhouse in Sakran, Balochistan, in June 2010. After a shootout with the alleged kidnappers, the captives were recovered. One of the suspects was killed during the raid and two others were arrested.

A case (FIR No.108/2010) was registered under sections 365-A (kidnapping for ransom) and 34 (common intention) of the Pakistan Penal Code read with Section 7 of the Anti-Terrorism Act at the Gadap city police station.
