KARACHI, Jan 31: A sessions court on Monday sentenced a man to nine years in prison in an attempted murder case.

The court found Fayyaz Ahmed alias Farman guilty of trying to kill a man, Noor Nabi, in July 2002 within the remit of the Baldia Town police station.

Additional District and Sessions Judge (west) Irfan Ahmed Mayo also imposed a fine of Rs30,000 and in case of default the convict would have to suffer an additional six-month imprisonment.

However, the court exonerated the accused from charges of murder and attempted robbery for want of evidence.

The convict was sent back to prison to serve out the remainder of his sentence.

According to the prosecution, on July 27, 2002 the accused along with his absconding accomplices broke into the house of Hazrat Nabi in Baldia Town for robbery. However, the inmates resisted and the accused opened fire leaving Gul Azam dead and Noor Nabi wounded. The police managed to arrest the accused the following day.

A case (FIR 96/02) was registered against the accused under Section 302 (premeditated murder), 324 (attempted murder), 398 (attempt to commit robbery when armed with deadly weapon), 109 (abetment) and 34 (common intention) of the Pakistan Penal Code.
