Action against police for trying civil court matters

LAHORE, Dec 30: Lahore High Court (LHC) Justice Kazim Ali Malik said police officials should be proceeded against under the law for interfering in civil court matters.
Justice Malik said this while granting bail to Nazar Abbas, accused of committing fraud in the purchase of a car on lease.
The Township police on the complaint of Sarfraz Ali lodged a case against Nazar under sections 420, 406 and 506 of the Pakistan Penal Code. According to the prosecution, the complainant sold his car under a lease purchase agreement to Khizar Hayat who did not pay the installments.
Both parties cancelled the agreement and the vehicle was handed over to Nazar under a new agreement. Nazar also failed to pay the outstanding installments to Sarfraz and also extended threats to Sarfraz who lodged a case against Nazar.
“I could not understand as to how and with what authority the police took cognizance of alleged breach of terms of lease purchase agreement between the parties,” said the justice.
“Although this court is always reluctant to interfere with investigation of criminal cases, administration of criminal justice cannot be left to the mercy of the investigating agency.
“In the case in hand the local police entertained a civil dispute falling within the exclusive domain of the civil court.
