MULTAN, Dec 30: Lahore High Court’s deposed judge Justice Jahangir Arshad on Sunday termed Dec 31 day of relief as LHC chief justice Iftikhar Husain Chaudhry makes an exit from the judiciary
Talking to Dawn telephonically, Justice Arshad said referring to the outgoing CJ that the person who had `disgraced’ his fellow judges failed to secure service extension from the government despite his keenness.
He said it was ironical that the emergency order of Nov 3 was a handiwork of Justice Iftikhar Husain and Attorney General Malik Muhammad Qayyum, but later it was Malik Qayyum who forced LHC CJ to retire.
He said Justice Iftikhar had not only defamed the LHC by obtaining decisions of his liking from junior judges but also violated traditions of the court.
He said the outgoing CJ remained in conflict with three chief justices of Pakistan — Justice Sheikh Riaz, Justice Nazimuddin Siddiqi and Justice Iftikhar Muhammad Chaudhary, resulting in strained relations between the apex court and the LHC.
He also alleged that the outgoing judge wanted biradri-based appointments of judges.
He said Justice Iftikhar transferred some judges to remote benches to punish them and ran the LHC through five junior judges, violating rules and orders of the high court in administrative matters.
He said the LHC chief justice was responsible for whatever had been done with Justice M A Shahid Siddiqi, while he forced the family of Justice Nawaz Bhatti, who died in a plane crash, to vacate the official residence. While on the other hand, Justice Nasim Sabir, who was terminated, was allowed to use the official residence for a year and the car for six months, he added.
He demanded the newly appointed LHC Chief Justice Zahid Hussain should reopen all the illegal and unconstitutional decisions of Justice Iftikhar and should appoint senior judges on these cases.
He also demanded that all those judges who were allegedly victimised by Justice Ifitkhar should be compensated and notice against the members of Punjab Bar Council issued by LHC full bench comprising junior judges be withdrawn.
He demanded a case should be lodged against Malik Qayyum and Justice Iftikhar under the article six, who, he said, were responsible for violating the Constitution and dismissal of the judges.
