KARACHI, Nov 13: The Additional District and Sessions Judge-II (Central), Nelofer Shahnawaz Azimi, on Tuesday issued non-bailable arrest warrants for a sub-inspector and bailable warrants for the arrest of an assistant sub-inspector (ASI) of Sharifabad police station, for not appearing in court despite repeated reminders in a death case of two college girls.
According to the prosecution, Nida Afzaal and Ravia Beenish, two intermediate students of the APWA College, Karimabad, were crushed to death and many others got injured on Feb 19, 2002 when an over-speeding bus of route 5-C bus (JA-5983) lost control.
The driver of the bus, Mohammad Munawwar, and bus owner M. Ibrahim were arrested and the Sharifabad police station had registered a case (FIR No 54/02) against them under Sections 320, 322 and 337 of the Pakistan Penal Code. They were later released on bail.
For the past five years, the police officials have not been appearing in court to testify as prosecution witnesses in the case. As they failed to appear as prosecution witnesses in the case on Tuesday, the court issued non-bailable warrants for Sub-Inspector Zafar Iqbal and bailable arrest warrants for ASI Irfan of the Sharifabad police station
The court also asked the
Sindh Home Department officials, Capital City Police Officer, Deputy Inspector-General and Senior Superintendents of Police concerned to ensure appearance of the police officials on Dec 3 for recording their statements as prosecution witnesses in the case.
The court also summoned Madeeha, Shahida and Saher Afshan, those students who had been injured in the accident.
Notice to health secretary
The same court issued a notice to the Sindh health secretary directing the official to ensure the appearance of two medico-legal officers (MLOs) of the Abbasi Shaheed Hospital in court in connection with a murder case.
Earlier on October 27, the court had issued non-bailable warrants for the arrest of the two MLOs for not appearing in the case for the last six years. However, on Nov 13, the two officials again failed to appear in court.
According to the prosecution Mohammad Younus, son of Mohammad Darvesh, had stabbed 14-year-old Mohammad Ghiyas, son of Mohammad Saleem, in Liaquatabad after an exchange of hot words with him in Super Market police limits on August 20, 2001.The injured boy could not survive though he was rushed to Abbasi Shaheed Hospital. The post-mortem examination of the body was conducted by Dr Sarfaraz Gul and Dr Zafar Shah. However the MLOs did not appear in court to testify.
The accused was booked under Section-302 of the Pakistan Penal Code in the case (FIR No 84/01) at Super Market police station.
The court has fixed Nov 15 as the next date of hearing and directed the police officials concerned to arrest and produce the MLOs in court.
