SC larger bench to hear petitiion against Musharraf ISLAMABAD, Oct 17 (PPI): The Chief Justice of Pakistan, Justice Iftikhar Muhammad Chaudhry on Wednesday held that the larger bench of the Supreme Court already constituted for hearing petitions against General Pervez Musharraf's candidacy for Presidential election held on October 06, will hear the case from Thursday instead of full court. The order passed by the CJ reads as: “In view of order passed by Bench-II, request of the petitioners has been considered once again. Meanwhile, the Registrar has also enquired from Justice Falak Sher, who has expressed his inability to be a member of the Bench hearing the listed petitions, as according to him he has already expressed his opinion on merits in the petitions. Same is the position of Justice Mian Shakirullah Jan, while Justice Rana Bhagwandas is out of country being on ex-Pakistan leave and Justice Nasir-ul-Mulk is proceeding abroad on official commitment on October 20 morning, whereas Justice Saiyed Saeed Ashhad is on medical leave. As far as the undersigned (CJ) is concerned, he feels that the judicial propriety requires that he should not sit in the Bench hearing petitions involving election of the incumbent President of Pakistan being holder of two offices.
