KARACHI, Feb 7: The National Accountability Bureau was allowed on Wednesday to file fresh comments on the bail application of former capital city police officer Tariq Jamil by February 19.

As the application came up for hearing, a division bench was informed that the comments submitted earlier had been misplaced. The Bureau sought permission to file fresh comments and the request was granted by the bench. The applicant is already on interim bail.

The bench, meanwhile, heard Advocate Azizullah Shaikh’s appeal in a credit card case. The appellant’s counsel, Qazi Iqbal Ahmed, submitted that the trial banking court held that the lawyer must have suffered mental torture, agony and humiliation because of dishonoring of the credit card issued to him by a bank but his claim for $100 million in damages was hit by Section 73 of the Contract Act. It allowed only $175 by way of damages against the delinquent bank. Further hearing was adjourned to Thursday.

RETIRED JUDGE’S PLEA: The Sindh High Court on Wednesday adjourned to February 27 the hearing of its retired judge’s plea that he is eligible to appear before it as an advocate.

Justice (r) Mohammad Sadiq Leghari said in response to an SHC office objection to a petition filed by him on behalf of a petitioner that he was fully competent to appear before the court. He said the relevant provision of Article 203-B barred former high court judges from practising in subordinate courts functioning under the high court. The bar was not applicable to the high court as it could not be said to be ‘functioning under its own jurisdiction’.

As the case came up before a division bench comprising Chief Justice Sabihuddin Ahmed and Justice Faisal Arab, Attorney-General Makhdoom Ali Khan and Advocate Khalid Anwar, who was to assist the court as amicus curiae, were not present.

Advocate Abdul Hafeez Pirzada, the other amicus curiae, said he would make his submissions after the attorney-general’s arguments. The bench adjourned the hearing for the AG’s arguments.
