KARACHI, Aug 28: The Sindh High Court extended the protective interim bail granted by it to former revenue minister Imtiaz Ahmed Shaikh in a number of cases till Oct 2. The applicant was sacked by Chief Minister Arbab Ghulam Rahim for alleged involvement in corruption. Subsequently he was booked in a number of cases pertaining to corruption, misdeclaration of assets, accumulation of wealth by misuse of authority, illegal possession of land and kidnapping and murder charges.

He approached the high court maintaining that he did not expect justice from the provincial agencies.

The court admitted him to pre-arrest bail in all the cases by different orders.

The orders came up for confirmation before Justice Ghulam Rabbani on Monday and he was requested to adjourn the matter due to the inability of the applicant’s counsel, Raja Qureshi, to appear. Allowing the request, the judge adjourned the hearing to Oct 2.

ORDER RESERVED: Justice Syed Zawwar Hussain Jaffery reserved order on a bail application moved by Dr Syed Kashif Matin for allegedly removing a patient’s kidney illegally. The accused submitted through Advocate Mohammad Ilyas Khan that the anesthetist and surgery technician have denied removal of kidney of patient Kashif during his operation in the statements recorded by them under Section 164 of the criminal procedure code. As for Ms Shahjahan, whose kidney was also alleged to have been removed by the accused, her ultrasound report refuted the allegation.

The counsel said the prosecution has failed to recover the kidney or name the donee or beneficiary on whom the organ was transplanted.

A kidney could be preserved in saline solution only for 48 hours and on expiry of the period, it became useless. He maintained that there was no evidence to corroborate the complainant’s allegation.

NOTICE TO BUILDER: A division bench, comprising Justices Anwar Zaheer Jamali and Syed Zawwar Hussain Jaffery, issued a show cause notice to a builder or obstructing inspection of his under-construction building by the court nazir.

The court had appointed its nazir to conduct inspection of the building on plot LY 7/18, Mir Mohammad Shah Road, Moosa Lane, Lyari. Petitioner Mohammad submitted through Advocate Abdul Jabbar Korai that the builder was raising a structure in gross violation of the approved plan and the building regulations.

When the nazir went to the site with the petitioner, the builder did not allow him to enter the premises and used offensive language against them. The bench issued the builder a notice to show cause why he should not be tried for contempt of court.
