KARAHCI, Jan 7: A division bench of the Sindh High Court (SHC) on Friday adjourned hearing of a constitutional petition filed by four nazims and two naib nazims till Jan 12, as the attorney-general of Pakistan was on general adjournment.
Earlier, Deputy Attorney-General Nadeem Azhar, appearing for the federation, submitted that the AGP was on general adjournment and would be available after Monday. Justice Rasheed A.Razvi (Rtd) appeared for the petitioners and submitted that when the question of interpretation of a law was involved, a notice should go to the AGP and such notice was issued on Dec 27.
He said the federation had been represented by the DAG who could proceed with the case. The counsel submitted that the advocate-general of Sindh might also be asked to argue case of the provincial government and the proceedings could be wrapped up with the arguments of the AGP.
The bench, comprising Justice Sarmad Jalal Osmany and Justice Zia Pervez, put off hearing till Jan 12 at 1pm. The petitioners, nazims of Larkana, Jacobabad, Mirpurkhas and Dadu and naib naizms Larkana and Mirpurkhas challenged their removal under Section 186(2) of the Sindh Local Government Ordinance after establishment of four new additional districts out of Larkana, Jacobabad, Mirpurkhas and Dadu.
DETENTION OF BABY: Justice Muhammad Moosa K. Leghari has directed TV artiste Nadia Khan to appear before the court on Jan 18, in a case of alleged detention of baby Alyzeh, born after her marriage with Khawar Iqbal.
A Sindh High Court bench on Friday was hearing a criminal miscellaneous application filed by Anjum Afzal, grand mother of the baby and mother-in-law of Ms Nadia Khan. When the matter was taken up, Advocate General Sindh Anwar Mansur Khan appeared on the court notice.
He raised objection to the jurisdiction of the court on the ground that it was a dispute between private parties. However, he stated that he would try his best to ascertain the whereabouts of the alleged detainee, two-and-a-half-year-old baby Alyzeh.
Ms Anjum Afzal alleged that the baby was in improper custody of the respondent who was a TV artiste and performed as host in stage shows and most of her time was spent in recordings.
She said that even minor negligence of Nadia Khan might pose threat to the life of the baby. Ms Afzal prayed to the court that for the well being and welfare of the minor, she should be handed over to the applicant who was so attached to her grand daughter.
Meanwhile, the father-in-law of Nadia Khan also challenged Talaq-i-Tafweez in the High Court through a lawsuit seeking injunction to restrain Nadia from acting upon Talaq-i-Tafweez as it was violation of Clause 18 of the Nikahanama and Section 8 of the Muslim Family Law.
BAIL GRANTED: Justice Mohammad Moosa K. Leghari on Friday granted pre-arrest bail to six men in an attempt-to-murder case. Police booked Malik Shafqat, Qamaruddin, Ghulam Qadir, Shafi Mohammad, Niaz Ahmed and Pandi on charge of an attempt to kill Malik Waheed and Punjoo, on Jan 4, 2005. -APP/PPI
