DHAKA, Aug 4: The High Court of Bangladesh on Wednesday rejected summarily a writ petition challenging the provision of holding general elections under the non-party caretaker government.

"The provision of caretaker government during national elections is a unique concept and the amendment (to the Constitution in this regard) is an unprecedented legislation", observed the three-member full bench of the High Court in its judgment.

The court, however, certified that the case involved a substantial question of law as to the interpretation of the Constitution and now an appeal to the Appellate Division of the Supreme Court on the judgment would lie as of right.

Petitioner of the writ, M. Salimullah, who is also an advocate of the Supreme Court, told newsmen after the judgment that he would file a regular appeal as soon as he would get the certified copy of the judgment.

"Experience shows that political party-government influences the government machinery to bring the election results in their favour", the court observed in its judgment detailing the historical background that led the introduction of the system caretaker government during national elections.
