KARACHI, Jan 15: A division bench of Sindh High Court, comprising Justice Ghulam Rabbani and Justice Azizullah M Memon, on Thursday repeated the non-bailable warrants for Qazi Nisar Ahmed, an activist of the banned religious organization , on an appeal filed by the State against the acquittal of respondents in a sectarian killing case.

The anti-terrorism court on Nov 27, 2000, had acquitted Qazi Nisar on charge of killing Dr. Sibtain Ali Dosa and two others in Kharadar area as prosecution failed to produce any evidence against the respondent.

When the matter was taken up before SHC's bench, the court was told by the police officer concerned that the NBW was not served on him. The court repeated the NBWs and fixed the matter for a date to be fixed by the office.

According to prosecution, an FIR was lodged at Kharadar police station Karachi on May 2, 2000, that Dr. Sibtain Ali Dosa of Dosa Clinic, their staff member Ali Nawaz and M. Arsahd Shahid were killed by unidentified persons at clinic. State filed appeal against acquittal of the respondent and prayed the court to set aside the trial court order.

Meanwhile, the same bench also repeated NBW against activist of Muttahida Quami Movement (MQM) Azam Shakir alias Tara on an appeal filed by the state against his acquittal in extortion case.

The SHC earlier granted the appeal of state and convicted the co-accused Abdul Rehman, who was also acquitted along with respondent by an ATC, to three years RI on Oct 31, 2002. They were prosecuted for demanding extortion from a businessman in Defence area.

On the last hearing, NBW was sent to SHO Clifton for their execution. But, neither the NBW was executed, nor SHO concerned submitted any report regarding the execution of NBW.

The court while taking notice of non-execution of the NBW to the respondent, directed the SHO concerned to furnish explanation on his failure in execution of warrant and ordered to repeat the NBW.-PPI
