KARACHI, Sept 12: A division bench of the High Court of Sindh (SHC) comprising Justice Wahid Bux Brohi and Justice Rehmat Hussain Jaffery, on Friday, issued bailable warrants of arrest of SHO Naing Sharif for Sept 18.
The warrants came while hearing a bail application filed by an accused Faiz Muhammad booked by Naing Police in a case registered under section 3/4 of the Explosive Act.
When the matter was taken up the SHO was absent. No reply of show cause, which had been issued to him, was present on the record. The court noted that earlier also he failed to appear before the court. Taking strong exception of the SHO’s attitude, the court issued bailable warrants of his arrest in the sum of Rs100,000.
The accused in his plea stated that he had been behind the bars for the last four years while the case against him had not proceeded.
The court summoned jail roll from the prison authorities and also called a report regarding number of cases pending against the accused. The jail authorities submitted the jail roll wherein it was stated that the accused had either been acquitted or enlarged on bail in a number of cases and instant case was the only one in which a judicial order was to be passed.
Meanwhile, the same bench also issued notices to Additional Director FIA for Sept 15 in two petitions challenging illegal detention of Faisal Sajjad and Agha Junaid.
The accused were booked and arrested by FIA (Crimes in Banking Cell) on charge of alleged fraud with the Union Bank Pvt. Limited.
INSPECTION OF RECORD: Justice Atta-ur-Rahman of Sindh High Court, on Friday, appointed Official Assignee (OA) of SHC as provisional manager to inspect and examine record of the White House Securities (Pvt) Limited.
The bench was hearing application filed by Additional Registrar of Companies, Security and Exchange Commission of Pakistan (SECP) against the respondent company.
When the application came up for hearing, Agha Fakir Muhammed, counsel for SECP contended, “In violation of memorandum of the association, the company is carrying on business which is otherwise not legally authorized to do so.”
The counsel also maintained that petitioner had received complaints from general public that company was collecting money without any lawful authority.
Z.K. Jatoi Advocate, appearing for the respondent, denied the allegation and referred to counter affidavit filed by the chief executive of the company before the court.
The bench ordered appointment of Official Assignee as provisional manager to examine and inspect the record of the company as to the nature of their business and submit report. The provisional manager was empowered to take assistance from any office from the State Bank of Pakistan while respondents were directed to cooperate with the manager.
The same bench passed an identical order while hearing an identical petition against the Wall Street Securities (Pvt) Limited. None appeared for the Wall Street Securities despite issuing notice.—APP
