Plea against holding two posts admitted

QUETTA, Sept 9: The Balochistan High Court division bench admitted here on Tuesday the petition challenging the holding of the posts of the chief ministership and party provincial presidency simultaneously, for regular hearing.

The bench, comprising Chief Justice Raja Fayyaz Ahmed and Justice Akhtar Zaman Malghani, has issued notices to Chief Minister Jam Mohammad Yousuf and the Election Commission of Pakistan in the petition filed by Mir Zarak Zehri, President of the Balochistan Pakistan Muslim League-Zia.

The plaintiff has maintained that according to the Political Parties Ordinance respondent Jam Yousuf cannot retain two posts — the chief ministership of Balochistan and presidentship of the provincial PML-Q — at the same time, and should be asked to retain only one of these.

GIRL’s POSSESSION: Meanwhile, in another case, the court directed that one Rufia residing in the Darul-Aman be handed over to their parents and her father Nasrullah Khan should deposit a surety bond of Rs100,000 in the court.

Mr Nasrullah and her wife Zainab had filed a petition that Rufia was their daughter and be handed over to them, but another application was filed by one Noor Ali and his wife claiming that the girl was their daughter.

The court had ordered for genetic information and a DNA test was of the girl was conducted at Lahore Laboratory to ascertain the real position. The test report verified that Rufia was daughter of Mr Nasrullah; and ordered action against Noor Ali and his wife.

DEATH PENALTY: Additional Sessions Judge Raja Jawaid Hasan Abbas awarded on Tuesday death penalty for three times to Nasir Ali when the prosecution proved that the accused had killed his father, mother and servant, besides injuring his sister in June 2003.
