KARACHI, Sept 9: A judicial magistrate directed on Tuesday the provincial police chief to initiate inquiry against a town police officer (TPO) and three SHOs for implicating an innocent man in a case.
JM Jhangir Dayo also ordered instant release of Kamran Mughul as the police produced him in the court, seeking his 14-day custody for interrogation in a case pertaining to possession of an unlicensed pistol.
The young man, arrested on Sept 7, by the Sir Syed police, was found in the lock-up of the North Nazimabad police on Monday during a raid conducted by two judicial magistrates — Ms Sarwat Sultana and Sultan Awan — on the orders of the additional district and sessions judge, Mohammad Aziz Jamali.
The ADSJ had ordered the two magistrates to conduct raids on North Nazimabad and Sir Syed police stations on an application of Kamran’s mother, Tasneem Khalid, for ascertaining the whereabouts of the young man.
The two magistrates were told by the North Nazimabad police that Kamran was booked and wanted by the Shahrah-i-Noorjahan police.
JM Jhangir Dayo ordered the Sindh inspector general of police Syed Kamal Shah to hold departmental inquiry against Sub-inspector, Bilal, SHO of North Nazimabad, Sub-inspector, Amjad Kiyani, SHO of Sir Syed, and Inspector Jawaid Hussain Bangush, SHO of the Shahrah- i-Noorjahan. The judge also ordered the IGP to initiate inquiry against the area TPO as the false case against Kamran was reportedly registered on the insistence of reader to the TPO.
Meanwhile, judicial magistrate East, Manzoor Ahmed Siddiqui, ordered the release of a worker of the Muttahida Qaumi Movement, charged with the possession of an unlicensed weapon.
The JM ordered the release of Haji Sultan alias Kapal as the home department withdrew prosecution of the accused.
The Muttahida worker was booked by the Korangi police in 1998.
GANG-RAPE CASE: The additional district and sessions judge, South, Ms Nuzhat Ara Alvi, put off the hearing of a gang-rape case against five accused, including three cops, as the two victim sisters, their father and brother did not turn up for their deposition.
The judge fixed Oct 4 for the next hearing of the case against Ismatullah, a constable of the Saddar Town, Malik Safeer, a dismissed cop, Qamar Iqbal, a constable of the CIA Saddar, Malik Hasnat, son of Inspector Malik Shabbir Awan, and Kashif, a laundry shop owner, who allegedly gang-raped two sisters in their Ranchore Lines flat on April 1, last year.
The five accused allegedly barged into the flat of Abdus Sattar, held the inmates hostage at gunpoint and gang-raped his two daughters, who were 19 and 22 years old respectively.
The elder sister, a divorcee with an infant, was allegedly raped by all five accused, and the younger sister, a maid, by accused Malik Safeer only.
The victim sisters and their father and brother identified the accused during the identification parades before a judicial magistrate.
The victim family is being given legal aid by the Lawyers for Human Rights and Legal Aid (LHRLA).
The court had earlier dismissed an application of the prosecution for transfer of the case to an anti-terrorism court for trial. Later, the state moved a revision application against the order of the trial court in the Sindh High Court. The application is still pending before the SHC.
