CBR asked to withdraw notice

ISLAMABAD, June 6: The Central Board of Revenue (CBR) has been asked to withdraw a notice issued to a person in violation of income tax law.

Federal Tax Ombudsman Justice Saleem Akhtar (retired), while taking decision on a complaint here on Friday, said the complainant had rightly pointed out that the sale agreement executed on January 1, 1994, was relevant for the assessment year 1994-95.

However, the property was transferred in the complainant’s name in October 1996, which related to assessment year 1997-98. There was no legal justification for reopening the assessment for the year 1996-97, the FTO added.

The complainant, Mohammad Zafar Iqbal, had alleged that on receipt of a notice, an application was registered with the commissioner of income tax, Multan, requesting him to quash the notice, but the commissioner rejected the application.

Zafar Iqbal further alleged that the regional commissioner of income tax also did not consider the facts of the case and rejected his application.

He said the reopening of the assessment for the year 1996-97 was unjustified as he neither sold nor purchased any immovable asset during the year 1995-96.
