BHC verdict set aside in Khalil reference

QUETTA, Oct 26: A division bench of the Supreme Court, setting aside a Balochistan High Court’s decision, on Friday remanded Dr Dad Mohammed Khawaja Khalil in the police custody.

The bench comprising Justice Iftikhar Mohammed Chaudhry and Justice Jawed Iqbal was hearing a petition filed by the National Accountability Bureau (NAB) against an early decision of the Balochistan High Court in a corruption case against Mr Khalil.

An accountability court had tried Mr Khalil in a corruption case filed by the NAB for misappropriating public funds while holding the office of the in charge of the Medical Store Depot, Balochistan, and accumulating wealth through illegal means.

The accountability court sentenced him, under section 10 of the NAB Ordinance, to prison for nine years and ordered the payment of a fine of Rs26.57 million and in case of default to further undergo for another three-year rigorous imprisonment.

He was also barred from contesting elections, holding public office or obtaining loan from financial institutions for ten years.

Mr Khalil then submitted an appeal before the BHC against the decision, upon which the high court accepted the plea bargain and ordered his release on April 10, 2002.

The NAB later approached the Supreme Court against the decision.
