KARACHI, Oct 9: The Sindh government has devolved the Karachi Building Control Authority under the devolution plan in pursuance of the provision of Section 52 and 54 of the Sindh Local Government Ordinance (SLGO) 2001, and with the approval of the competent authority. The devolution will take place with immediate effect as under:
The role and functions assigned to the KBCA under the Sindh Building Control Ordinance 1979 and the Karachi Building Control Licensing Regulation (KBCLR), 1982 are devolved to the towns’, except the following, which shall remain with a nucleus office in the city district government.
i. Regularization of 260 and other buildings constructed in violation of the law/regulations under the Sindh Regulation and Control (Use of Plots and Construction of Buildings) Ordinance 2002.
ii. Building by-laws and regulations updating/amendments/ reframing etc and matters pertaining to the Anomaly Committee.
iii. Coordination with various committees, including the Heritage and Protection of Buildings Committee.
iv. Computerized data and information.
Building control functions in each town will be performed by a town building control officer (TBCO)/controller of buildings (COB).
Each town, according to the work load, has been assigned a deputy controller of buildings (DCB), assistant controller of buildings (ACB), building inspectors (BI) and complimentary staff. A consolidated statement of posts as per the approved organization of each town is annexed to facilitate the town administration and officers concerned to function/report for duty.
Inter-seniority of officers/officials of the KBCA will be maintained by the administrative department. Transfer/posting of staff within the CDGK/towns will be made in accordance with APT Rules, 1974 and notification bearing No. SO (Land) HTP/6-41/99 dated April 4, 2002.
Two controllers of buildings with complimentary staff are assigned to the nucleus office with the CDGK under DO (building control) to coordinate functions of the nucleus office.
The nucleus office will be headed by a DO (building control, former CCOB) under EDO (W and S), CDGK.
The deputed officer(s) in the KBCA from the KDA, will be repatriated to the CDGK.
The two doctors; appointees of the KBCA, will be absorbed by the health department of the CDGK.
The KBCA, through generation of funds, is meeting its entire non-development expenditure. Each town, therefore, in pursuance of Section 52 and 54 of the SLGO 2001, will have to generate enough resources to meet the cost of non-development expenditure of its building control wing, including demolition (squad) and litigations (legal advisor). The CDGK will bear the non-development expenditure of the nucleus office.
Deployment of complimentary staff according to the organization of each town shall be made by CCOB, KBCA within 15 days of the issuance of this notification.
Each TBCO/COB will work in accordance with the SBCO, 1979/KBCLR 1982 and Building and Town Planning Regulation 2002.
The legal wing and structure wing staff of the KBCA will look after the work of litigation and structure/design respectively of the town(s) as assigned to them as per notification to be issued separately.
Building control offices will be maintained in every town (on permanent basis) in accordance with the provision of Section 52 and 54 of the SLGO.
The Sindh Building Control Ordinance 1979, Amendment Act 1982 will remain in force for the time being, till an amendment is made in the law.—APP
