KARACHI, July 31: A division bench of the Sindh High Court on Wednesday fixed state’s anti-terrorism appeal for Aug 13, seeking death penalty for the three accomplices of Ahmed Omar Saeed Shaikh in Daniel Pearl case.

When the matter came up before the bench, comprising Justice Sarmad Jalal Osmany and Justice Musheer Alam, the court put on notice the respondents and also directed AAG, Habib Ahmed, to ensure that paper book of the case is prepared in time.

On the same date, appeals of Omar Shaikh against his death sentence and of the three accomplices against life term has already been fixed.

Being aggrieved and dissatisfied from the judgment pronounced by the ATC judge at Hyderabad in special case No. 26/02, AG Sindh Raja Qureshi had on July 16 filed the appeal in the Sindh High Court for enhancement of sentence of Fahad Naseem, Syed Salman Saqib and Sheikh Muhammad Adil, who were convicted and sentenced Under Section 7 of the Anti-Terrorism Act, 1997 to suffer imprisonment for life.

It is the case of the state that the case made up by the prosecution against the four accused is based on conspiracy, in furtherance of which separate acts were committed by all the four accused with the common intention as well as the meeting of the minds, falling within the concept of criminal conspiracy.

“Hence the accused would not in any manner deserve a punishment lessor to what has been awarded to the principal accused Ahmed Umer Saeed Shaikh” the AG said.
